These Terms of Service (“Terms”) govern your use of the website operated by Elite Oral Surgery & Dental Implants, PLLC (“Elite Oral Surgery,” “we,” “us,” or “our”), located at https://myeliteoralsurgery.com/ (the “Site”), as well as our text messaging program and other electronic communications.

By accessing the Site, submitting information through a form, requesting an appointment, joining our opening list, opting in to receive text messages, or otherwise communicating with us electronically, you agree to these Terms. If you do not agree, please do not use the Site or our online services.

We may revise these Terms from time to time. Updates will be posted on this page with a new Effective Date.

1. ELIGIBILITY AND ACCEPTABLE USE

You must be at least 18 years old, or act with the involvement and permission of a parent or legal guardian, to submit information through the Site, request an appointment, join our opening list, or enroll in our text messaging program.

You agree to use the Site only for lawful purposes and in a manner that does not interfere with its operation, security, or accessibility.

• Submit false information or another person’s information without authorization.
• Enroll a mobile number that you do not own or are not authorized to use.
• Attempt to gain unauthorized access to the Site, its systems, accounts, or data.

• Introduce malicious software or interfere with the Site’s operation or security.
• Use the Site or its content to promote another business without our written permission.

2. INFORMATIONAL PURPOSE; NO DOCTOR-PATIENT RELATIONSHIP

The Site provides general information about Elite Oral Surgery, oral and maxillofacial surgery, dental implants, treatment options, pricing considerations, and patient resources.

Site content is provided for general informational and educational purposes only. It is not a diagnosis, treatment plan, or substitute for an examination and advice from a licensed healthcare professional.

Accessing the Site, submitting a form, joining our opening list, exchanging email or text messages, or requesting an appointment does not create a doctor-patient relationship. A doctor-patient relationship is established only after you have been accepted as a patient and the relationship has been documented by the practice.

If you are experiencing a medical emergency—including uncontrolled bleeding, difficulty breathing, or facial swelling or infection accompanied by fever—call 911 or go to the nearest emergency department. Do not rely on website forms, email, or text messages for emergency care.

3. APPOINTMENT REQUESTS AND OPENING-LIST SUBMISSIONS

The Site may allow you to join an opening list, submit an inquiry, request an appointment, schedule through an external service, or otherwise contact our office.

A submission is a request only and does not guarantee an appointment, establish a treatment relationship, or reserve a particular date or time. An appointment is confirmed only after our office or scheduling provider verifies availability and contacts you.

You agree to provide accurate, current, and complete information. We may modify, reschedule, or decline a request because of provider availability, scheduling conflicts, emergencies, incomplete information, clinical considerations, or other reasonable circumstances.

4. SENSITIVE INFORMATION AND ELECTRONIC COMMUNICATIONS

General website forms, ordinary email, and SMS text messages are intended for routine inquiries, scheduling, and non-urgent communications. They are not secure channels for detailed medical histories, clinical records, imaging, diagnoses, financial account information, or other highly sensitive information.

Please use only a secure method provided or approved by our office when sending clinical information, photographs, imaging, or other protected health information.

Information created or maintained in connection with your care may be protected health information under the Health Insurance Portability and Accountability Act (“HIPAA”) and applicable Washington law. Such information is governed by our separate Notice of Privacy Practices, which is available from our office. If that notice conflicts with these Terms concerning protected health information, the Notice of Privacy Practices controls.

Electronic communications can be delayed, intercepted, misdirected, or accessed by someone with access to your device or account. Please consider these risks before communicating electronically.

5. PHONE, EMAIL, AND SMS COMMUNICATIONS

By providing contact information through the Site, requesting an appointment, joining our opening list, or otherwise communicating with us, you authorize us to respond using the contact methods you provide.

Non-marketing communications may include responses to inquiries, appointment confirmations and reminders, scheduling and rescheduling notices, pre- and postoperative instructions, care-coordination messages, billing or insurance communications, and other practice-related updates.

Elite Oral Surgery SMS Program

Elite Oral Surgery operates a text messaging program using a third-party messaging platform and telecommunications providers. Messages sent through this program may constitute Application-to-Person (“A2P”) messaging.

How You Opt In

You may opt in by:

• Entering your mobile number, checking the separate SMS-consent checkbox on a Site form, and submitting the form.
• Affirmatively agreeing in writing or electronically to receive text messages.
• Using another opt-in method that we clearly present to you.

Consent to receive marketing or promotional text messages is not a condition of purchasing a product, receiving treatment, or otherwise obtaining services from Elite Oral Surgery.

By affirmatively opting in, you agree to receive recurring automated and conversational SMS or MMS messages from Elite Oral Surgery at the mobile number you provided. You represent that you own or are authorized to use that number.

Types of Messages

Depending on the consent you provide and your interactions with us, messages may include:

• Appointment and care messages: Scheduling, confirmations, reminders, rescheduling notices, preparation information, and follow-up instructions.
• Conversational messages: Two-way responses from our team regarding your inquiry or visit.

Program Details

• Message frequency varies based on your appointments, requests, and interactions with us.
• Message and data rates may apply according to your mobile carrier and service plan.
• Elite Oral Surgery does not charge a separate fee for its text messages.
• Mobile carriers are not responsible for delayed or undelivered messages.
• Delivery is subject to the availability and operation of wireless networks and messaging providers.

How to Opt Out

You may cancel SMS messages at any time by replying STOP to a message from us. We may send one final message confirming your opt-out. After that confirmation, we will stop sending messages covered by that opt-out unless you later provide new consent.

Your opt-out from text messages does not prevent us from contacting you through another method when permitted by law, including when reasonably necessary for treatment, payment, healthcare operations, or to respond to an inquiry you initiate.

Mobile Information and Privacy

We do not sell or rent your mobile number or SMS opt-in information. We do not share mobile information, including opt-in data or consent, with third parties or affiliates for their own marketing or promotional purposes.

We may disclose mobile information to service providers that help us operate and support the SMS program, including messaging-platform providers, telecommunications carriers, and customer-support vendors. They may use the information only as necessary to provide those services or as required by law.

6. INDIVIDUAL RESULTS VARY

Surgical results and recovery depend on factors including anatomy, bone volume, bite forces, medical history, medications, tobacco use, oral hygiene, healing response, and compliance with care instructions.

Photographs, testimonials, timelines, implant counts, diagrams, and descriptions of individual cases are illustrative and do not guarantee that another patient will obtain the same outcome.

Any treatment timeline presented on the Site describes a typical or estimated course. Your treatment plan and recovery may differ. Recommendations specific to you can be made only after an appropriate clinical evaluation and imaging.

7. PRICING, INSURANCE, AND FINANCING INFORMATION

Fees, financing examples, or all-inclusive figures displayed on the Site describe general pricing for qualifying or standard cases as of the date shown. They are not a binding quotation, guarantee, or offer to contract.

• Your actual fee will be provided in a written treatment plan after an appropriate evaluation.
• Additional procedures, materials, or services may involve separate charges when clinically necessary.
• Insurance benefits and coverage decisions are controlled by your insurance plan. We cannot guarantee payment or coverage.
• Financing and prequalification services are offered by independent providers. We do not control their approval decisions, interest rates, credit requirements, payment terms, or promotional offers.

Questions about a financing decision or agreement should be directed to the applicable financing provider.

8. VIRTUAL CONSULTATIONS AND SUBMITTED MATERIALS

If the Site provides a virtual-consultation or secure-upload feature, you represent that you have the right to submit the photographs, records, and other materials you provide.

A virtual consultation or preliminary review is informational and non-diagnostic unless our office expressly tells you otherwise. It does not replace an in-person examination, appropriate imaging, or a complete medical history.

Do not submit another person’s records or photographs without their authorization or the legal authority to do so.

9. THIRD-PARTY SERVICES

The Site and our communications may rely on third-party services, including:

• Appointment and practice-management systems.
• Secure forms and file-transfer services.
• SMS, telephone, and email providers.
• Payment processors and financing providers.
• Mapping and directions services.
• Website hosting, security, analytics, and advertising services.

The Site, its content, and our SMS program are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim express and implied warranties concerning the Site and messaging program, including warranties of accuracy, merchantability, fitness for a particular purpose, availability, and non-infringement.

We do not guarantee that the Site or messaging program will be uninterrupted or error-free, that every message will be delivered, or that all content will remain current or complete.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Elite Oral Surgery and its owners, clinicians, employees, contractors, and affiliates will not be liable for indirect, incidental, consequential, special, or punitive damages arising from:

15. GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.

Any dispute concerning these Terms or use of the Site will be brought in a state or federal court with jurisdiction in Pierce County, Washington, and you consent to the jurisdiction of those courts.

16. SEVERABILITY, NO WAIVER, AND ENTIRE AGREEMENT

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of that provision or any other right.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the agreement between you and Elite Oral Surgery regarding the Site and SMS program. They do not replace patient consent forms, financial agreements, treatment plans, or our HIPAA Notice of Privacy Practices.
